Terms of Service

Welcome to NeonNode.nl. These Terms of Service (the "Terms") govern your access to and use of the products, services and websites provided by NeonNode.nl (collectively, the "Services"). By using or accessing our Services you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. General

1. 1.1 These Terms apply to all accounts, purchases and use of the Services provided by NeonNode.nl.
2. 1.2 NeonNode.nl reserves the right to modify these Terms at any time. Material changes will be posted on our website. It is your responsibility to review these Terms periodically.
3. 1.3 Nothing in these Terms creates an employment relationship, partnership or joint venture between you and NeonNode.nl.

2. Accounts & Use

1. 2.1 You must provide accurate and complete information when registering for an account and keep your account information up to date.
2. 2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. 2.3 NeonNode.nl is not liable for any loss or damage resulting from unauthorized use of your account.

3. Fraud & Abuse

1. 3.1 Any suspected fraud, payment fraud, chargeback abuse, misuse of services or other abusive behavior may result in immediate suspension or termination of access to the Services.
2. 3.2 In the event of suspected fraud, NeonNode.nl may investigate the matter and share relevant information with financial institutions or law enforcement authorities as required.
3. 3.3 Fraud or abusive conduct will not entitle the user to any refund or compensation.

4. Illegal Activities

4.1 You must not use the Services to engage in activities that are illegal, harmful, or infringe the rights of others. Examples include, but are not limited to:

• launching or facilitating DDoS attacks;
• phishing, distribution of malware, or unauthorized access to systems;
• hosting or distributing copyrighted content without permission;
• running fraud, scams, or any activity that uses our infrastructure to harm others;
• unauthorized cryptocurrency mining, or other unauthorized resource-intensive operations.

4.2 If NeonNode.nl determines, in its sole discretion, that you are using the Services for illegal purposes or in breach of these Terms, NeonNode.nl is authorized to immediately suspend or terminate the Service without prior notice and without any obligation to provide refunds.

4.3 NeonNode.nl may disclose information about you and your use of the Services to law enforcement or other third parties where required by law or where NeonNode.nl reasonably believes disclosure is necessary to prevent harm or enforce these Terms.

5. Payments & Refunds

1. 5.1 All fees for Services are payable in advance and are non-refundable except as otherwise expressly provided in writing by NeonNode.nl.
2. 5.2 No refunds will be issued after delivery of the service, unless NeonNode.nl expressly agrees in writing. "Delivery" includes activation, provisioning, or first successful deployment of the purchased service.
3. 5.3 Chargebacks or disputed payments that are determined to be unjustified may result in immediate termination of the Services and additional recovery actions.
4. 5.4 If a payment fails or is reversed, NeonNode.nl may suspend the affected Services until payment is resolved. You remain responsible for any unpaid amounts and related costs.

6. Service Availability & Support

1. 6.1 NeonNode.nl uses commercially reasonable efforts to maintain a stable network and low latency, but does not guarantee uninterrupted access or 100% uptime.
2. 6.2 Scheduled maintenance, emergency maintenance, incidents, or other events may cause temporary disruption. NeonNode.nl will notify affected customers when practicable.
3. 6.3 NeonNode.nl is not liable for data loss, service interruptions, or consequential damages resulting from service disruptions.

7. Data & Privacy

1. 7.1 NeonNode.nl processes personal data in accordance with its Privacy Policy. By using the Services you consent to such processing.
2. 7.2 You are responsible for backing up your own data. NeonNode.nl may, but is not obligated to, provide backup services as described in separate service agreements.

8. Termination

1. 8.1 You may cancel your Services in accordance with the cancellation procedures available in your account dashboard.
2. 8.2 NeonNode.nl may suspend or terminate accounts or Services for users who breach these Terms, engage in fraud or illegal activities, or fail to pay fees.
3. 8.3 If NeonNode.nl terminates or suspends a Service due to your breach or illegal activity, you are not entitled to any refund.

9. Limitation of Liability

1. 9.1 To the fullest extent permitted by applicable law, NeonNode.nl's liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you actually paid to NeonNode.nl in the six (6) months preceding the event giving rise to the claim.
2. 9.2 In no event will NeonNode.nl be liable for any indirect, incidental, special, punitive or consequential damages, lost profits or data, even if advised of the possibility of such damages.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory law provides otherwise.

11. Changes to the Terms

NeonNode.nl may update these Terms from time to time. When material changes are made, we will provide notice through the Services or by other means. Continued use of the Services after changes constitutes acceptance of the updated Terms.
